NOTICE OF APPLICATION

The following applications have been received by the City of London.  The Planning and Environment Committee will be considering these applications at a future public meeting, the date and time of which will be published in the Londoner.  If you have any questions or would like to provide comment, please see “Providing Comment” below.

464-466 Dufferin Ave & 499 Maitland St – The purpose and effect of this Official Plan and zoning change is to permit the use of an eat-in restaurant, maintain four (4) residential dwelling units and recognize existing site conditions.  Possible amendment to the 1989 Official Plan to ADD a Special Policy Area to permit an eat-in restaurant within the ground floor of the existing building within the Low Density Residential designation. Possible amendment to The London Plan to ADD a Special Policy Area to permit an eat-in restaurant within the ground floor of the existing building within the Neighbourhoods Place Type, located along a Neighbourhood Street. Possible change to Zoning By-law Z.-1 FROM a Residential R3/Convenience Commercial (R3-2/CC) Zone TO a Residential R3/Convenience Commercial Special Provision (R3-2/CC(_)) Zone to permit an eat-in restaurant use, maintain four (4) residential units and to recognize existing site conditions. If a person or public body would otherwise have an ability to appeal the decision of the Corporation of the City of London or of the Approval Authority to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of London before the application is adopted or approved, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of London before the proposed amendment is adopted or approved, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

MINOR VARIANCES

The Committee of Adjustment for the City of London will meet on Monday, November 25, 2019, commencing at 1:20 p.m., on the second floor of City Hall, 300 Dufferin Avenue, London, Ontario for the purpose of hearing the following applications for Minor Variance to Zoning By-law Z.-1.

2:20 p.m. – A.119/19 - 502 Egerton Street, PLAN 320 LOT 10, on the east side of Egerton Street, south of York Street. To permit an Office use. REQUESTS: To change from a non-conforming Wholesale/Retail Party Supply Store to a non-conforming Office use.

2:40 p.m. – A.121/19 - 3080 Bostwick Road, WESTMINSTER CON 2 PT LOTS 38 AND 39 RP 33R7568 PT PART 1, on the east side of Bostwick Road, south of Southdale Road West. To construct a commercial office building and an apartment building. To permit a minimum front yard setback of 13m, whereas a minimum front yard setback of 18m is required.

2:50 p.m. – A.122/19 - 776 Wellington Street, PLAN 237 LOT 2, on the east side of Wellington Street, north of Oxford Street East. To construct an addition. To maintain a minimum south interior side yard setback of 0.0m, whereas a minimum interior side yard setback of 1.2m is required. To permit a maximum garage façade width of 56%, whereas a maximum garage façade width of 50% is permitted.

If you wish to be notified of a decision of the Committee of Adjustment, you must appear in person or by Counsel at the hearing and file a written request with the Secretary-Treasurer of the Committee of Adjustment.  An appeal from a decision of the Committee of Adjustment to the Local Planning Appeal Tribunal (LPAT) shall be filed within 20 days of making the decision. CONSENTS

The London Consent Authority will be considering the following application for consent. Comments are due November 21, 2019 to the London Consent Authority.

B.048/19 – 49 Edwin Drive- Request to sever approximately 42.45m2 from 49 Edwin Drive and convey to 45 Edwin Drive for the purpose of existing residential uses. The retained lands, 49 Edwin Drive, will have an area of approximately 549.53m2 for the purpose of future residential development. Planner: M. Vivian

If a person or public body that files an appeal of a decision of the City of London Consent Authority in respect of the proposed consent does not make written submissions to the Consent Authority, before it gives or refuses to give a provisional consent, the Local Planning Appeal Tribunal (LPAT) may dismiss the appeal.
