NOTICE OF CANCELLATION – PUBLIC MEETING

NOTICE OF APPLICATION

The following applications have been received by the City of London.  The Planning and Environment Committee will be considering these applications at a future public meeting, the date and time of which will be published in the Londoner.  If you have any questions or would like to provide comment, please see “Providing Comment” below.

666-670 Wonderland Road North – The purpose and effect of this zoning change is to permit a medical/dental office use. Possible change to Zoning By-law Z.-1 FROM a Highway Service Commercial Special Provision/Restricted Service Commercial Special Provision (HS(3)/RSC2(1)) Zone TO a Highway Service Commercial Special Provision/Restricted Service Commercial Special Provision (HS(3)/RSC2(__)) Zone to permit a medical/dental office use in addition to the uses permitted by the existing zoning and to recognize a parking rate previously approved through a minor variance application of 1 space per 11m2 for all uses on site. NOTICE OF INTENT TO REMOVE A HOLDING PROVISION

City Council will consider removing the Holding Provisions as applied to the lands described below at a future Council Meeting.  Council will not hear representations from the public on these matters.  If you have any questions or comments about this matter, please call the planner identified below.

180 Villagewalk Boulevard - City Council intends to consider removing the h-5, h-99 and h-100 holding provisions from the lands, to allow for a 12 unit cluster townhouse development.  The holding provisions are in place to ensure: a public site plan meeting occurs; that the development design is consistent with the Upper Richmond Village – Urban Design Guidelines, and that adequate water looping and access is provided, all to the satisfaction of the City.  Council will consider removing the holding provisions as they apply to these lands no earlier than September 9, 2019. If a person or public body would otherwise have an ability to appeal the decision of the Corporation of the City of London or of the Approval Authority to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the City of London before the application is adopted or approved, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to the City of London before the proposed amendment is adopted or approved, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

MINOR VARIANCES

The Committee of Adjustment for the City of London will meet on Monday, August 26, 2019, commencing at 2:10 p.m., on the second floor of City Hall, 300 Dufferin Avenue, London, Ontario for the purpose of hearing the following applications for Minor Variance to Zoning By-law Z.-1.

2:10 p.m. – A.078/19 – 134 Riverside Drive – To construct an addition. To permit a front yard setback of 5.8m, whereas 7.1m is the minimum required. REQUEST: To maintain a west interior side yard setback of 0.8m.

2:20 p.m. – A.083/19 - 820 Wharncliffe Road South, WESTMINSTER CON 1 PT LOT 30 PR 33R9183 PARTS 27 TO 29 32 PARTS 30 31, east side of Wharncliffe Road South, north of Southdale Road East. To construct an addition with a gross floor area of 7.0 m². REQUEST: To maintain the existing 298 parking spaces, whereas 299 parking spaces are required.

2:30 p.m. – A.084/19 - 39 Cliftonvale Avenue, PLAN 450 LOT 156 TO 158, south side of Cliftonvale Avenue, west of MacKay Avenue. To construct an accessory structure. To permit an accessory structure in the required exterior side yard, whereas accessory structures are not permitted within a required front yard or exterior side yard.To permit an accessory structure with an exterior side yard setback of 1.2m, whereas a minimum of 6m is required.

2:40 p.m. – A.085/19 - 2299 Buroak Drive, PLAN 33M635 LOT 12, south side of Buroak Drive, west of Yellowbirch Court. To construct a swimming pool. To permit a swimming pool within the required exterior side yard, whereas swimming pools are restricted to the interior side yard or rear yard.To permit a swimming pool with an exterior side yard setback of 3.0m, whereas 4.5m is the minimum required.

2:50 p.m. – A.086/19 - 27 Evergreen Avenue, PLAN 311 PT LOT 5 AND RP 33R16718 PART 2, 25 Evergreen Avenue PLAN 311 LOT 4 PT LOT 3, 21 Evergreen Avenue PLAN 311 PT LOT 3, 19 Evergreen Avenue PLAN 63 LOT 2, 17 Evergreen Avenue PLAN 63 PT LOT 1, on the north side of Evergreen Avenue, north of Horton Street West. To re-establish lot lines.

27 Evergreen Avenue – To permit an east interior side yard setback of 2.3m, whereas a minimum of 3.0m is required, to permit a lot coverage of 11.5% for an accessory structure, whereas 10% is the maximum permit.

21 Evergreen Avenue – To permit a lot frontage of 13.7m, whereas 15.0m is the minimum required, to permit a parking area setback of 2.0m, whereas 3.0m is the minimum required.

19 Evergreen Avenue – To permit an east interior side yard setback of 1.7m, whereas 1.8m is the minimum required, to permit a landscape open space of 22%, whereas 30% is the minimum required, to permit a parking area coverage of 43%, whereas 35% is the maximum permitted, to permit a parking area setback of 0m, whereas 3.0m is the minimum required, to permit a lot coverage of 10.1% for an accessory structure, whereas 10% is the maximum permitted.

17 Evergreen Avenue – To permit a lot frontage of 12.2m, whereas 15.0m is the minimum required.

If you wish to be notified of a decision of the Committee of Adjustment, you must appear in person or by Counsel at the hearing and file a written request with the Secretary-Treasurer of the Committee of Adjustment.  An appeal from a decision of the Committee of Adjustment to the Local Planning Appeal Tribunal (LPAT) shall be filed within 20 days of making the decision.
